DEA & De'Shon Sanders

[Note by Seth C, 12/04/08 11:47 AM CST ]  Let's be real careful about implicating Crabtree or Sesay before all the smoke clears.  These are some pretty serious allegations.

I'll find it very hard to believe that nothing will happen to Crabtree and Sesay out of this one when it's all said and done.

ESPN Article:

A reserve Texas Tech defensive back was arrested by federal agents early Thursday and charged with dealing cocaine.

Junior De'Shon Sanders, arrested in downtown Lubbock at 1:30 a.m. Thursday by agents of the U.S. Drug Enforcement Administration, has been charged with felony possession with intent to distribute in excess of 50 grams of cocaine, DEA public affairs spokesman David Ausiello said Thursday.

Sanders is being held in Lubbock County jail, according to the Lubbock Avalanche-Journal.

Texas Tech associate athletic director Chris Cook confirmed that Sanders is a housemate of All-American receiver Michael Crabtree and junior defensive end Brandon Sesay. Neither Crabtree nor Sesay has been implicated in the investigation of Sanders, a law enforcement official with knowledge of the case said.

However, the official said, both players were in the apartment when DEA agents searched Sanders' room in the middle of the night, following his arrest.

The 22-year-old Sanders, of Hobbs, N.M., is a transfer from City College of San Francisco. He hasappeared in all 12 games for the Red Raiders and made four tackles.

I can't speak about Sesay...

or his disposition because I’ve never seen or read much about his character, but from everything I’ve ever seen or read about regarding Crabtree’s character is that he’s a good kid who usually goes out of his way to separate himself from this type of foolishness. Let’s hope that holds true for not only him, but Sesay as well.

Giving Crab and Sesay the benefit of the doubt

A similiar thing happened to me. I had 3 roomies who enjoyed the weed. The rule was do not bring it into the house becuase if something happened, I would lose my job and would have problems as an officer in the Army Reserves.

One day I walked into a pot party. I took off work the next day, found a new house, and moved out by the weekend. Roomates to stupid stuff. Crab seems like a guy who understands what is at stake. If they didn’t nab him by now, my guess is he wasn’t involved.

My first thoughts

- DEA usually means an investigation has been going on for at least some time.
- Perhaps Crabtree and Sesay helped with the investigation, either voluntary or not.
- I would hope that Crabtree knew his career possibilities, and I think he knew well enough to keep out of this situation. I certainly hope I’m right.
- I had a roommate my freshman year of college (before Tech) that was involved in dealing (pot). I had nothing to do with it, and when he did finally get busted I was relieved and never even questioned by anybody about his situation. I’ve been squeaky clean all my life, just had a roommate that made bad decisions. I’ve been there before. I’ll wait on implicating anybody else.
- Coaches are not to blame. Their control is limited.
- Can’t wait to see this on the front pages of the Aggie/Longhorn blogs. Can’t say I blame them. I hate this.

excess of 50 grams...

seems like a pretty small amount to pique the DEA’s interest. I wonder if they are going after a “weakest link” in the chain in hopes of making him turn over his source for immunity or if Mr. Sanders maybe transported the yay across state lines in addition to trying to sell. DEA involvement means to me that there is much more going on here than we’re being told.

That’s a BOAT load. I was a prosecutor before turning defense attorney. In Texas Penal Code, penalty Group 1, (coke, meth, etc…) over 50 grams is a 1st degree felony! I prosecuted someone w/ 56 grams of meth. You don’t even have to prove intent to deliver, because it’s already the highest level offense you can get, except for “Capital.” Less than one gram is personal use SJ Felony. To put that into perspective, aggrevated assault is a 2nd degree, you could shoot someone and get agg asslt. more perspective; 4 oz to 5 lbs. of marihoochie is a state jail felony, between a real felony and a misdemeanor. This is some REAL serious crapola!

I’m still prosecuting after 30 years. 50 grams is $5000 worth street value. And it may not be limited to that since “over X grams” is how the statutes are written. This would be the Fed statutes instead of Texas so I don’t know the punishment range, but he’s in serious doo-doo either way.

I didn’t mean that 50 grams was a small amount in the grand scheme of things. I merely meant that it was a relatively small amount for the DEA’s interest to be piqued (knowing their general M.O.) and is suspect in that he’s probably not the main target of their investigation, but rather a piece in the puzzle.

You're right in that sense

The Feds have certain ‘deminimus’ standards, meaning they don’t fool with the little stuff. You can defraud a Federal bank and they just let the locals handle it if it doesn’t get over a quarter mil or so. I also notice the indictment talks about conspiracy. That’s a REAL broad stroke with the Feds. He may be right in the middle of it, or he may have just loaned his car to the wrong guy. Only time will tell. Plus the Feds have a hard on for crack cocaine right now.

I just hate that our name got drug into it.

“body of evidence” where’s the beef? I guess someone would have had to buy it from him, ie udercover agent. Usually possession cases are immediate arrests. I agree about the conspiracy thing. I wish I knew what they had on the kid. Usually when we knew kids were being used as mules, we cut them some serious slack.

Dallas Morning News.....

has a little more detail account. It says there were no drugs found in the apt. and the arrest stems back to an incident that happened in New Mexico June 7&8, 2008. Also, as has been mentioned the authorities were quick to clear Crab and Sesay saying there were no other arrests and the roommates were not involved. Still not good.

It says in the espn article that the offenses took place in June in Hobbs, NM near Sanders hometown…can’t be quick to judge, it’s always good to presume innocense.

No, the reason athletes get away with so much crap is because they hire rich attorneys. College kids don’t hire rich attorneys. There is absolutely no indication that De’Shon Sanders is going to “get away” with anything. He’s just been charged with a very serious federal crime. If you aren’t capable of distinguishing between collegiate unpaid athletes and rich professional ones with expensive legal teams, then there’s nothing I can say to help you.

The reason people like Crabtree and Sesay will “get away” with living in the same house with someone who commits a crime is because it is not a crime to live in the same house with a person who commits crimes.

The reason that we have jury pools in this country is because of the risk that people like “yourself’s” (nice) will find their way to an actual jury. That’s a terrifying societal risk but, unfortunately, an all too real one.

There is no way Crabtree is innocent he just as guilty if he knew what was going on.

First off, what evidence do you have that he knew “what was going on”? Second, to the degree that the state believes Crabtree or Sesay aided and abetted Sanders, they will charge them. They haven’t. The garbage you’re spouting is simply guilt by association. Guilt by association, in the judicial system, goes by another name: Innocence.

You might as well be UT or OU fans let players get away with everthing.

If the alternative to being compared with you is being compared to UT or OU, I’m fine with that. I don’t think “fans let players get away with” anything, ever. I can’t collect my buddies and go march on Lubbock prison demanding the release of De’Shon Sanders. I wouldn’t if I thought it would help, because I don’t have any interest in helping that kid. I also don’t have any interest in reading some crazy fool cryptically state: “if you ride with an outlaw you die with an outlaw.” Grow up.

A tiny minority of both professional athletes and collegiate athletes are criminals. The conclusion most want to reach is not unlike the one you’ve reached: there is some criminal epidemic here and rationalizing incidents like the one above is enabling. The problem is, this conclusion is simply wrong. It should surprise you that violent crime arrests are actually LOWER for NFL players (considered by many to be the most violent of all the American sports, and one of the most ridden with criminals) than it is for the general public. You can be an armchair psychologist about it or you could open a book/study:

It is interesting that the NFL players, who do earn a living largely through the exercise of their physical strength — and who may even be seen to thrive on their violent encounaters on the football field — still seem to have a lower rate than the comparable general population.

Apparently that isn’t limited to violent crimes:

According to the San Diego Union-Tribune, since the year 2000, an average of one in 45 NFL players gets arrested. Comparatively speaking, that number is one in 23 non-football playing citizens, according to the FBI. Approximately one third of those NFL arrests stem from some form of drunken driving. The drunken driving arrest rate of NFL players in one in 144, compared to a national rate of one in 135.

So NFL players, who if the newspaper coverage is any indication never drive SOBER, actually get arrested for DWI less than the average citizen. And NFL players, who the vast, vast majority of were, at some point, collegiate athletes, are about half as likely to be arrested as you or I, statistically speaking. If judging needs be done here, it should be Michael Crabtree waving a finger at you, the non-football player.

I know it must be much easier to sit at home and point fingers and blame and judge and do all those things our current civilization has gone to great lengths to keep people like you from actually doing, especially since dismantling our biases and prejudices about athletes and crime would require a huge investment of time in reading and research and appreciation for logic and nuance. Sounds boring. You’re probably better off sitting at home drinking beers and yelling at the TV about those damned athletes always criminalizing and selling the hooch and bla bla bla bla. It’s easier that way. It’s not true, mind you, but ignorance can be a whole lot of fun, too.

people are innocent up until that moment a jury says otherwise. I’ve had roommates. Some of them have been arrested in the past. That’s life. That doesn’t make me guilty of anything.

You’re free to think whatever you want. Michael Crabtree sells cocaine. Michael Crabtree is responsible for the Holocaust. Whatever. If you aren’t relying on evidence to make accusations against him, who cares what you say? He killed jesus.

my final statement

My main argument is if someone in your household is dealing drugs you must think it is ok to do so. Therefore your ethical clock is messed up and there are things I ’m sure you are doing wrong. I deal with drug dealers and people associated with them every day and everyone is guilty of something if you let it happen. guilt by association is not innocent it conspiracy.

Don’t worry I am not in law enforcement and never have been in law enforcement. I am no way associated with the judicial system. I just have worked in many locations that were in the ghetto’s. I have had my life threaten by drug abusers and I have heard many times that so and so will never do it again only to get arrested for the same offense moths later. I just study people and I know that people just don’t do things once they are creatures of habit and repetition.

He was being extradited. The incident that he was arrested for occurred during the summer in New Mexico. He had nothing on him and there was nothing in the apt. Apparently, this was a DEA operation and they had to wait for the grand jury to arrest him.

and it’s Tommy Tubberville, Auburn, Washington Huskies, if Leach goes, I want Briles. I get back to the office and WTF? I’m POed. People are gonna think this is freaking Miami U. Folks, even with our DB Sanders, he’s innocent until proven guilty, and believe me there’s a great difference between innocent and not guilty.
