The Saga of Mike Leach and Texas Tech: Contract Negotiations
Now This is a Quagmire
When Mike Leach talked about his contract status on Wednesday, my response was this:
The thing I find most interesting is that Leach basically said, "Gerald, it’s your move."
Well, Gerald did move.
"Check, Captain Leach."
First and Foremost
Everything quoted here is from LAJ's Don Williams and DMN's Brandon George. Both journalists have done an outstanding job of detailing everything that's gone on here. Kudos and congrats.
Who Thought to Even Ask?
So here we are, magically, every news source in and around the Lubbock area now has access to every email and piece of negotiation between Leach, Leach's agents, Gary O'Hagan and Matt Baldwin of IMG Sports, and Texas Tech University.
I'm not real sure how to say this, but doesn't this all seem a little coincidental? I'm making some assumptions here, but how outrageous would it be if someone from the school and athletic department sorta mentioned that all of the communications between the school would fall under the Freedom of Information Act? Friday morning, Ryan Hyatt mentioned that by the time Monday rolled around, Texas Tech fans would have a whole new view of the negotiations. It happened a lot faster than that. Quite simply, I think that someone perhaps mentioned to reporters to make the request and Texas Tech's hands would be tied. They would be forced to produce the information.
And boy did they.
It's About the Money
As much as we'd like to think it's not about the money, it is about the money. Last year, in April Leach and his agents asked for a 5 year deal for $15.25 million ($3.05 million/year), which would have vaulted Leach ahead of Mack Brown ($2.91 million/year) for a college coach's compensation.
It's about the money.
December 5, 2008, Texas Tech offered to Leach a contract worth $12.1 million over 5 years ($2.42 million/year) and Leach's agent's countered on December 16, 2008 at $14.25 over 5 years (part 2) ($2.85 million/year). On January 9, 2009 Myers and Texas Tech counters at $12.7 million ($2.54 million/year) which includes a bonus of $600,000 if Leach completes his contract. January 20, 2009 Leach and his agents accept the base salary of $12.7 million over 5 years ([Note by Seth C, 02/07/09 8:15 AM CST ] REMEMBER: The four provisions that Leach and his agent are balking at now are in this January 9, 2009 offer. Leach and his agent accepted the terms of those provisions on January 20, 2009), but asked for an additional $1.15 million in incentive bonuses as follows:

Please explain to me how it's not about the money?
I want to be clear, I have no problem with it being about the money, but don't tell me it's not about the money. It's always about the money.

Unacceptable Items
In Texas Tech's January 9, 2009 offer, Leach's agents claim that there are four items in this contract that are unacceptable.
- Early Termination: Texas Tech is offering a buyout of $300,000 per year for every year remaining on the contract. Leach's agent says that the Big 12 average is 50% rather than the offered 13.5%. Again, I think Texas Tech is calling Leach's flirtations into question. If Leach is really committed to Texas Tech then what's the problem? If he signs a 5 year contract, he should be committed to the University, without any sort of issue of buyout. I can somewhat understand Leach's position that the University can terminate the contract without cause for the same amount, but it seems that Texas Tech's stance is, what's good for you, is good for us too.
- Permission To Interview: Heaven forbid that Leach not be able to continue to interview anywhere he pleases. Leach has flirted with Miami, UCLA, Clemson, Tennessee and Washington within the past two years of being Texas Tech's head coach. One of the items that Leach feels is inappropriate with Texas Tech's latest offer is that Leach must ask AD Gerald Myers for permission to interview.
This is not a problem for me in the very least. Leach has done enough looking for me. Either I want someone completely committed to Texas Tech or don't want him in Lubbock. I know that people look for jobs all the time, but the free reign that Leach has had over the past two years is too much.
Myers said in an email in December of 2008 the following:
"We want you as his agent to stop shopping Coach Leach everywhere and him not saying anything to deny that he's looking for another job."
This is the game of chicken that Leach and his agent have been playing for the past two years and now the it's time to pay the piper (sorry for mixing metaphors, etc.).
- Buyout: Leach's current contract sits at a flat rate of $500,000, which means that should Leach jump ship to another job, Leach only has to pay a $500,000 fee to Texas Tech. Texas Tech countered in it's latest offer is that the initial buyout is $1.5 million, but that amount is reduced by $300,000 for each year that Leach completes of his contract. Thus, by the end of the term there will be no buyout, at the end of next year, the buyout will be $1.2 million, the next year it's $900,000, etc. Seems completely reasonable to request a higher buyout, but that assumes the coach wants to continue to coach at a particular university. What this means for Leach is that he has to be somewhat committed to Texas Tech and obviously, that's not what he wants.
- Personal Likeness Rights: At first, I thought this was the one item that I thought was too much in favor of Texas Tech, but then I read Hyatt's updated post on Friday afternoon regarding this sticking point:
Lots of folks will have a hard time understanding O’Hagan’s complaint about the outside income-marketing issue via the newly minted deal Tech has with Learfield Communications as of today. If I’m reading it right, it merely brings Leach in-line with what Pat Knight and Kristy Curry are already doing, which is to allow Tech go generate much more than the 10K a year Mike currently "earns" whether he "earns" it or not. Anything done by Leach’s agents would still go to Leach, like say a commercial for 50-Yard Line Steakhouse or Dog Food. Again, there isn’t anything about that clause that seems out of line or unreasonable and for O’Hagan to say so seems a bit disingenous to me.
I also sort of read this last provision to mean that the school will control Leach's likeness while he's working for Texas Tech, which again makes sense. The head football coach is a representative of the school and oftentimes the figure-head for the program. I can understand why Texas Tech would want to control that image somewhat. In retrospect, and knowing that this current provision is in similar contract provisions with Pat Knight and Kristy Curry, it doesn't bother me so much.
Again, this has no effect on the compensation that Leach's receives.
Going Above Everyone's Heads
On January 13, 2009, Myers emailed to IMG that he and Texas Tech were sorry that Leach and his agents have declined Texas Tech's January 9, 2009 email. One of Leach's agents, Matt Baldwin, decided that because he wasn't getting anywhere with Myers and Kent Hance it would be pretty cool to just go above their heads and email the Texas Tech Board of Regents, stating in part:
"We feel that there has been some misinformation about our position regarding the most recent contract offer made by Texas Tech. This feeling is based on some of the questions that Mike has been asked from some board members and boosters. In the interest of accuracy, we have prepared a chart which compares four elements of change that were introduced at the eleventh hour."
On January 16, 2009, Texas Tech board of Regents Chairman F. Scott Dueser responded to Baldwin's email as follows:
"I cannot adequately express the level of disappointment I feel that you would take the liberty of communicating directly with certain members of the Board of Regents regarding the status of your negotiations with Chancellor Hance, President Bailey and Athletic Director Myers without at the very least showing them the courtesy and respect of receiving a copy of your communication. If your message was calculated to divide the Board or undermine the Chancellor, President and Athletic Director, you have greatly misjudged us and the mutual respect we have for one another."
On January 20, 2009, Leach and his agent state that they are ready and willing to accept the current, January 9, 2009 offer, but asks for $1.15 million more money in bonus money.
It's not about the money.
As of January 20, 2009 in an email from Baldwin to Myers, Leach was fine with the four provisions in Texas Tech's January 9, 2009 offer, but increased the bonus incentives detailed above.
On January 28, 2009 Baldwin emails Myers and now he expresses that Leach feels that these four provisions are unacceptable.
It's not about the money.
Last night on KCBD Channel 11, (hat-tip Tech 92), Hance essentially said that Texas Tech is done negotiating with Leach's agents.
Deadline: February 17, 2009
This is Texas Tech's deadline for Leach to sign the contract. I'll go more into what I think will happen on that date as we get a little closer, but my initial thought is that it doesn't look good for anyone involved.

Nope…looks pretty bad. But I am glad all this info came out. I would rather an institution I will support many years after a coach leaves take the higher road in this sort of thing, regardless of outcome. And it appears Tech has in this negotiation. We may not all agree with the proposed terms, but the attitude of Meyers and Hance has clearly been one of professionalism and West Texas courtesy. The Leach/IMG team don’t really come across all that great, do they. What with the disingenious interpretation of the buyout and the end run to the BOR.
At the end of the day, having Mike Leach as our coach is not the reason I am a fan and supporter of Texas Tech. In fact, it’s probably down around reason number 3,067. I will always be a fan, no matter who we trot out there as coach.
Leach? Well, if he leaves I’ll be a casual observer of his next stop, but I won’t pine for the guy. As stated previously on many occassions, I’ve always felt he was a bit of a snake and a typical cocky coach on the inside inside. Not that that’s bad, but most people genuinely felt Leach wanted to be at Tech. It’s clear to me based on the negotiating rhetoric that that is not necessarily true by any stretch. He wants his money…then he wants his freedom to interview at will…then he wants to win…then he wants to be at Tech. In that order.
I feel much better about the position Tech has taken with him, that’s for sure.

I have read the AJ and the DTN versions of this
With all of the remarks and everything else, it is very clear about one thing: Coach Leach and Gerald Myers are not friendly to one another. Kent Hance will obviously back his AD over any coach. It is also obvious that Mike Leach is not committed to a career spent at Texas Tech, just wants to use Tech as a step to another, probably higher profile, school. Now, I do not know how much influence his agent have in all of this, but Mike Leach is a lawyer first and foremost. It shows in these negotiations and I really doubt that his agents are any more than mouthpieces here. Mike controls his own destiny. Because of the ongoing nature of his actions over the past few years, it is clear he wants to move on to another place, because he is making some drastic requests for compensation. Likewise, I do feel the Tech powers (Myers & Hance) are trying to keep a stronghold on the situation with some possibly unnecssary requests of their own, or at least a bit over the edge requests. Texas Tech should be better able to handle this and I don’t feel it is being handled by either side very well. It would be wonderful if Mike would agree to the terms and move on, but if he is not as committed as we would like or as much as the AD & President would like, then the door is left ajar for him to do whatever he wants. Tech will survive regardless, with or without ANY of the entities involved. The problem is Tech is taking a big negative hit with all of this contract negotiation stuff. I hope it does not set Tech back after all this is done in the minds of the rest of the nation. Recruiting is affected by the perceptions presented by each institution and this could hurt Tech for a while if it is not handled properly. I hope all concerned look seriously at where Texas Tech fits in this scheme and do what is best for the institution, not for the betterment of any one or two individuals. The parties involved need to sit down face-to-face and settle this quickly, then move on from there, regardless of the final decision.

I would submit that while Tech is losing a little face on this, the real loser in the court of public opinion with be Mike Leach. Other coaches will back Leach, other institutions will back Tech. I don’t think any of the contract demands are outrageous and enough to remotely scare off a potential replacement.
Every contract has protections built in for both sides. Leach just doesn’t want ANY that favor Tech. Shame on him for thinking he can just get his money and get his way because he said so. I promise, if he leaves over this, years down the road this will be a big career regret. I also am quite confident that when Leach finds his nirvana job it will be a very short lived experience. There is a unique fit for Leach at Tech, and vice versa. His overall goofy act probably won’t go over as well somewhere else or for as long as it has here.
Leach is a good (not great yet) coach. He’s got great potential to be somebody. But he is shooting himself in the foot over this and will regret these last two months.

Seth, I think you’ve got a bit of misinformation in there. Leach’s agents did not agree to tech’s additional provisions on Jan 20th. In fact, they said that their counter proposal was the same money package with the additional clauses package unchanged (except that tech’s early termination $$ was half of the remaining money on the contract)
Otherwise a good writeup, but it’s not quite not about the money.

I read this exceprt
from the DMN this morning:
Baldwin counters with terms he says that “Mike Leach is ready and willing to accept.” In the proposal, Leach’s agents seek $1.15 million more in incentive bonuses but maintain the primary compensation offer of $12.7 million over five years.
Which I took to mean he accepted the terms.

I bet much of this would go away........
If we announced Gerald’s retirement party in May. I will beat a dead horse and state that he lasted 15 years longer than I thought…..and he did good things in leading the hire of Leach and his friendship w/ Knight.
Scenario #1- Mike stays…they are at odds and will not have a good working environment
Scenario #2-Mike leaves…..potential candidates will see what happened here and Gerald will not be an attractive boss.
Lets buy the gold watch and give Mike the Early termination and the personal likeness clauses. Stay steady on the permission to interview and buyout. For god’s sake, pay him one Million Dollars (Dr Evil) for winning the National Championship at friggin’ Texas Tech.

Makes me sick
Well basically the man I want to stay at Tech so badly is a greedy liar. I’m sure his agents are in good company with him. It really pisses me off thinking that he can be so demanding at this point in his success. I agree he is the best coach we’ve ever had and may go down as the best we will ever have but it seems to me that Tech has done what it can to do at this point. As a bleeding red raider fan and alum I stand behind the schools stance on this despite our probably losing him soon. We’ll recover and move on and who knows it maybe a blessing in disguise. With so many people barely getting by these days I find it insulting that Leach can’t agree to the money presented. You can’t demand Mack Brown or Stoops money with winning a conference championship or contending for a BCS period. Besides all this he should have been focused on winning the Cotton Bowl and recruiting at the end of the season and he wasn’t. Enough said.

Looks like it's at least as much about the $$$
There are discrepancies between what Leach said he desired, and what his agents are asking for. Mike got caught trying to twist perception into thinking that he was taking the high road, when it was, in fact, Tech. Go Tech!

Very Proud of Tech here...
After a night of reading these items has made me sick overall about this situation, but relieved in my new found respect for how Tech is handling this. Through these negotiations, it has been made for us to believe that Mike Leach didn’t care about money and wanted to stay… now after seeing his Agents’ negotiations, we finally get to see that it has been anything but that. The man wants more money and the rights to shop around to any college he wants, when he wants… THAT IS A MAN WHO DOESN’T WANT TO BE HERE. Not only that, that is a man who wants to use Tech as his own personal stepping stone.
Bottom line, if Leach agrees, then he means what he has been putting out to the press for these months… if not, his true colors have been exposed. Now I hate to reach this conclusion about a man I have stood behind for so many years, but this situation has been put ON ALL OF US AS FANS! We should NOT have to put up with a coach that wants to keep looking for other jobs. My own personal thanks to whomever made this information available to us as fans…. This is what we have wanted all of this time, if he leaves he leaves and Tech will move on, but we DESERVE as fans to know what is really behind it all.

The Cap’n may not have a problem with the money, but, the IMG evil empire may want more of what he makes, I wonder how much Baldwin gets < as a bonus< of the additional moneys IMG makes off the Cap’n????

Great work Seth!
I think the whole thing has been amazing and a joy to watch.
The fact that is being played out in such a public manner is refreshing, I am sure that this same drama takes place at every big time football university, just behind closed doors.
Both sides are doing a great job fighting to control the negotiations. Hance and his West Texas mannerisms, Leach with his West Coast laid back pretentiousness, and of course the evil agents that are being vilified as demons from hell.
I would give them all A+.
I do not think it will tarnish TECH or Leach no mater how it comes out.
It just is not that big a deal to anyone outside the Tech family. The rest of the world realizes that BIG $$$$ always has this effect negations, families, business….
I am glad that the Austin American Statesman did not realize that all of the communications between the school Leaches team would fall under the Freedom of Information Act. If they had published the story before national singing day it could have had a bad impact

Makes me sick
Everytime I see the break down of the extra compensations for winning pisses me off!
It is complete crap that we are paying these coaches extra money for doing their jobs = winning. How about not getting fired if you don’t win??

Most of the things he asks for are reasonable -within this broken system that is…. The one thing that I do think he needs to compromise in these proceedings, is the talking to other schools clause. His interviewing and bargining with other schools all the time undermines the cohesiveness of the team and school when we consistantly have to worry about our coach leaving.
