Looks like Coach Tuberville may have registered his kids for school in the Frenship ISD before Leach was even fired. Whoopsie Daisies. That one is going to sting a bit.

this is a fact only blog site. We would never speculate as to what the belltower boys are up to. We would never speculate as to why the coach with the most wins in Tech history would be fired for disciplining a slacker. We would only deal with the facts when it came to who our new coach might be. We would believe hance when he mentioned how much he loved Ruffin McNeil and Mike Leach. Oh yeah, we won’t assume anything any more.

“In a related motion filed late last week, Leach’s attorneys subpoenaed the Frenship Independent School District for records pertaining to Leach’s replacement, Tommy Tuberville, and his family.
They’re asking the district to turn over documents involving the Tuberville family, particularly those pertaining to possible enrollment in district schools.
Tech hired Tuberville in early January about two weeks after firing Leach.
Dicky Grigg, an attorney with Spivey & Grigg law firm in Austin and a member of Tech’s legal team, said he was unsure about why Leach is seeking the records.
"I’m just sort of puzzled about it," he said. "It’s an act of desperation to bring in coach Tuberville’s children."
Grigg wasn’t sure when Tech began speaking with Tuberville about filling Leach’s position, but he said he knew it was after the termination.
Liggett declined to comment about the subpoena.
Frenship ISD has filed a motion to deny Leach the documents, citing federal student confidentiality laws. Sowder, in turn, has scheduled a hearing on the subpoena for March 26.
David Backus, an attorney with the Underwood law firm who is representing the district, said it is reluctant to release any record without the judge’s approval.
Backus, however, was unsure whether such records exist."

Depositions in a civil lawsuit don’t normally begun until after written discovery (disclosures, interrogatories, and document production) occurs – that would have been roughly at the end of February.

Maybe the family just really liked Frenship ISD
and planned to enroll there regardless. Katfish could have landed a job as the volleyball coach, or at Dunkin Donuts, but hey, whaddya know, the head football coaching gig at Tech just opened up. I guess I’ll apply. The benefit package isn’t great but the commute isn’t too bad.

Random request or more???
Thinking about this. Could be a random request for records, but could be something there. Always wonder how someone would find out info like this.
Obviously it would look really, really bad if coach T’s kids were enrolled prior to Leach being fired.
I’d have to think he is probably smarter than that. But the flipside is why would Leach’s lawyers pursue this if they didn’t have some sort of information???
Pretty clear that coach Leach is ready to go head to head against these guys. Tech’s attorney acting like he has no idea why you’d pull this move is rediculous. Any logical person knows why you pull this move.
I for one hope Leach keeps fighting and it somehow leads to exposing our Admin for what and who they are.

I know logic isn’t something that everyone has been blessed with cough Hance, Bailey, Meyers cough and I’m not a lawyer, although I did stay in a Holiday Inn Express a while back, but it does seem plain as day why Leach’s law team would want these records.
IF, big IF people, Tubs did, in fact, enroll his kids here before the Captain was officially fired he destroys all credibility with me (not that that matters much I’m sure).
It would be hard for me to support the Tubster knowing he was aware of the shenanigans going on in the Bell Tower.

I actually agree with this....
however, if it turns out that there was nothing there, and Leach and his counsel drug the kids of an innocent coach through this process just to see what sticks, I will be equally disapointed with coach Leach.

Extremely Unlikely
that Tubs enrolled his kids prior to the firing. Leach and his lawyers are REACHING with this request and it really is sad to see them sink that low.
Even though its fairly obvious to anyone that Leach’s firing was planned prior to the shed incident, proving that is a totally different story. Even the infamous e-mails between Hance and Sowell, as indicting as they may seem, still do not prove (in court) that Leach was fired for anything other than breach of contract.
I hope Ligget has some other, more substantial evidence to make his case…because if they are depending on kid’s school enrollment documents, they are doomed.
How does looking at these records drag the kids through the mud?
Leach is asking for any information involving Tubs and his family, not just enrollment records. If it comes out that Tubs was talking to the school before the firing, then it doesnt necessarily make him that bad a guy. Just further incriminates the bell tower boys. If not, then it makes it look more legit. How is this a low blow? I think its a smart move on Leach’s part.
I think it's likely Leach's team has been told something....
to that effect, and will more than likely have to disclose what they think is in those records if they want them released. If in fact they were told this may be true, they have every right to explore that line of thought in my mind. On the other hand, if they are simply throwing these notions out there to stir the pot of public appeal, it is a very disgusting tactic being it involves the children of a unrelated party, and i would be very ashamed of the captain for allowing that. None of this is fact of course, just my legally retarded opinion. In the end, it seems like a big gamble. If you know something fishy was going on and you can prove it, they may very well be the final nail in the coffin of the bell tower boys. But if it’s just slimy lawyer tactics, Tech lawyers are going to jump on it, and parents all across Raiderland are going to lose some measure of respect for the Captain.

If I were a judge (and im definitely not)
I would make the school release the documents, but add some sort of stipulation that the grades and such must not be released to the public. IMO, checking to see when a couple kids were enrolled in a school has no real affect on them.

If his kids were ENROLLED before the leach firing that means they had been talking to tubberville for quite some time, worked out a deal, WHILE the who leach scandal was going on…ya right, not even the USC administrators could have pulled this off.

Even high school kids know not to discuss anything confidential in an email. I give them the benefit of the doubt and think that yes, they are dumb enough to try it.

I was discussing this at the dinner table last night, and my father in law brought up the point that if this is all true, Ruffin was really mistreated. What are the chances he could bring a suit? Minority coach gets interviewed even though he really never had a chance at the job.

Dickey deserves better; so does Knight

Texas Tech basketball coach James Dickey just wants to be told if he’s being replaced by Bobby Knight.
Texas Tech head coach James Dickey shares a laugh with referee Dave Bair before his team’s loss Thursday to Oklahoma State in the Big 12 tournament.
And Charles Durning wants to be taller, and Dick Cheney wants cleaner arteries, and Juliette Binoche wants to win the Stanley Cup.
And yet at last look, according to several sources including the Lubbock paper, the coach who has been left to twist slowly in the wind by his athletic director, Gerald Myers. Dickey said he asked the boss three times, the most recent being Wednesday night, if he is about to be shoved down the elevator shaft, and has gotten no answer whatsoever.
Now that’s no way to start a new job, let alone end an old one.
This isn’t about Bob Knight, in case you Indiana recidivists started feeling your neck tighten. Bob Knight is a coach out of work, and as near as anyone can tell, Texas Tech called him, not the other way around.
And that has always been the trick with Knight — knowing what he has done wrong without blaming him for things he didn’t. Both lists, after all, tend to run long.
So let’s move past Knight, and get back to Dickey. He is an alum, and a loyal employee. Texas Tech has reached the NCAA Tournament under him, most recently in 1996. In short, the man is not a coaching slob.
On the other hand, his last four teams have had losing records, and that sort of thing doesn’t go over well in Texas, whether it’s Dallas, Lubbock or Godforsaken Junction.
Not only that, Dickey knows how “that sort of thing” works. Thus, it isn’t the potential firing that ought to be grinding at him, although it probably isn’t putting much spring in his step.
It’s not getting a straight answer from a man who owes him at least that. If Myers wants Bob Knight, fine, and if he has to fire Dickey to get him, fine again. But to say nothing at all is unreasonable.
I mean, what are the options here?
“James, we’re going in a different direction.”
“James, we’re going in Bob Knight’s direction.”
James, we want you to stay, but we don’t want to watch any more losing basketball, capisce?"
None of those sentences take more than a few seconds, and Myers doesn’t even have to offer Dickey much beyond that, although a beer and a tear might be nice.
And it isn’t the burdens of the Big 12 Tournament that stand in the way, either. Denny Crum was gently muscled out the door at Louisville, but he knew it was coming, and even though it was unpleasant, he feels comfortable enough with the process to stay in the athletic department.
Sad? If you’re a Louisville fan old enough to remember the two national titles, sure. But not as unpleasant as it could have been, not unfair, and quite nearly dignified. Stuff happens, but it doesn’t have to happen with a sandbag to the nethers.
It doesn’t have to happen that way for James Dickey, either. He has earned a better sendoff than “We’ll get back to you,” or its corollary, “Can you get off my porch?”
And as far as that goes, Bob Knight deserves better than to resume his coaching career with the sentence, “Yeah, the guy before him got a raw deal at the end.” He’ll be sufficiently reminded of his sins while at Indiana that being saddled with even the indirect criticism of James Dickey’s last days on the job.
One good thing did come of this, though. We learned that Lubbock’s daily newspaper is called the Avalanche Journal, the coolest name for a paper until someone sends us a copy of the Medicine Hat, Alberta, Daily Snowstorm and Influenza Outbreak."

These guys are blatant. They are still living in the 80’s, before internet and blogs and DTN. Tech is not a regional interest anymore but I don’t think they can see that. I think Katfish has a great chance to be successful at Tech, but will he cut the same sort of deal? Does he get to name the next head football coach? I don’t think anyone can say that’s not possible.
These backroom deals don’t go over as easily as they used to.
