Your Help Is Needed:  DTN reader Bryan emailed me yesterday and One Bronco Nation Under God is trying to determine public enemy #1 for Boise St. Bronco fans.  Currently they are making the case against Craig James.  Obviously, they need your help.  I've gone over to OBNUG and linked to Leach's 4th amended petition as a start.

Texas Tech Files Answer, Seeks to Dismiss Lawsuit:  Texas Tech filed an answer in an attempt to dismiss Mike Leach's lawsuit.  TracySaulRulz posted a FanPost yesterday and Let's Go Tech! posted a FanShot.  I'll be honest, most of this legal mumbo-jumbo is above my head.  Despite being an attorney, I won't even pretend to know what I'm talking about as to Texas Tech's defense of the suit.   As TSR noted, this is an interesting bit of spin.  I don't recall a press release when Leach filed the aforementioned 4th petition.  LAJ's Matthew Mcgowan has quotes from both sides:  "Leach's case has no merit" and "Texas Tech is in deep trouble".  Mcgowan notes that the reason why this is coming up now is that Judge Sowder is about to rule on Texas Tech's sovereign immunity defense.  In any event, it also appears that athletic trainer Steve Pinnock's testimony is going to be the key to the lawsuit.  Both sides seem to be relying on the events that transgressed. 

It seems as if the crux of Texas Tech's answer is new testimony from Pinnock and a new affidavit from Dr. Robert Cantu, a really important neurological surgeon, who believes that Leach's treatment of Jennifer James' concussion was inappropriate (I've redacted an inappropriate name):

"I am troubled to think of the extremely negative effect that this humiliating treatment of Adam Jennifer James by Coach Leach most probably had on other members of the football team. The treatment of Adam James would have a chilling effect on teammates reporting their own concussion symptoms and in my opinion was an entirely inappropriate message to send to these student athletes."

Personally, I don't think this affidavit is worth the paper it's written on and my opinion on this may be completely inaccurate, but right now, there seems to be sufficient dispute as to the facts of the case.  The fact that Dr. Cantu thinks that Leach's treatment of Jennifer was inappropriate seems like it will be something that will be tried if, and this is a big if, Leach can overcome the sovereign immunity defense.  If Leach overcomes the sovereign immunity defense, then the facts will be played out like in any other case and a jury will make a decision.  But I serious doubt that Dr. Cantu's affidavit will cause the judge to completely dismiss the suit.

PD: Really looking forward to the big rivalry games like Kansas vs. Kansas State and Texas vs. Texas Tech. The matchup I’m actually looking forward to the most is Oklahoma vs. Florida State. Though, I grew up a Florida State fan as a kid.

Unsolicited Advice:  EDSBS's Spencer Hall gives Alabama fans some unsolicited advice about repeating as a national champion.  This is actually great advice for any fan of any team and something to keep in mind when discussing whether or not this team is better than last year's team.  Just as Texas Tech fans may not appropriately consider the contributions made by Daniel Howard and Brandon Sharpe and some may easily think that other players will pick up the slack.  It's natural to think this way and Texas fans will do the same thing (QB Garrett Gilbert will pick up where McCoy left off or something like that). 

High School Linebackers:  ESPN's Gerry Hamilton reviews the 2011 linebacker class and Texas Tech commit Devon Hocutt gets a mention:

The Texas Tech commit will likely make the move to the defensive line at the next level. The 5-11, 268-pounder with 4.8 speed and a true love for competing is a prospect to keep an eye on. Hocutt seemingly shows up at every combine looking to compete and gain as much experience against top-notch competition as possible.

Also mentioned is Trey Brown who is apparently waiting on a Texas Tech offer:

The 6-1, 205-pound hard-hitter has offers from Oklahoma and Houston along with interest from Texas Tech, Oklahoma State and others from around the region. Texas Tech is the favorite of Brown as he patiently awaits an offer. The past two seasons he has been part of one of the faster defenses in the Dallas/Fort Worth area.

No Arms, But Focused:  DMN's Chuck Carlton writes about the Red Raider baseball club, in particular the fact that Texas Tech has very few pitchers, but continues to win Big 12 conference games. 

The Natural wasn't this improbable, which is why Spencer is relishing the season.

"This club, with what they do with what we have, has been as rewarding an experience as I've ever been around in college baseball," Spencer said.

And that includes the two College World Series titles Spencer helped Oregon State win as associate coach in 2006 and '07.

I can deal with the Stooges trying their case in the press, but it really irked me to get their press release in an email from the Red Raider Club. Is this how they spend the time and resources that are supposed to be dedicated to promoting scholarships?

I was having a great evening until I checked my phone and saw the email. The Alumni Association should stick to sending out announcements about golf tournaments and Red Raider wine.

What gets me

is that they went and got this neurological surgeon and had him make comments on how the treatment of aj would affect the other members of the team and their reporting of their own injuries. What in the world does that have to do with brain surgery?!?!? And, how does being a surgeon qualify him to make generalizations about human behavior in a court of law? Admittedly I did not go read the whole thing, just Seth’s clip… I’m sure he included all kinds of medical mumbo jumbo in his statement, but this part should be totally ignored by the judge.

Also really proud of our baseball team. Glad to hear they are having some success.

Another Reason

To continue boycotting financial support of the Alumni Association. What a bunch of douche drizzle’s to think they could slide that one through in a show of unity with the administration. That sealed the deal for me for another 24-36 months. Do you know how many cool toys I’ll have now since I’m not donating money to Tech? This is going to kick ass! Toy #1 was an iPad and well worth the purchase in case you were wondering.

What about no flash? I went into the apple store during the masters and picked up an ipad. Couldn’t access the MASTERS WEBSITE! If it can’t replace a laptop for casual internet browsing then I don’t get it… I fully understand Jobs stance on Adobe but you can’t expect to boycott most of the sites on the internet and have people buy the thing (they have sold a million though). I can put up with it on the iphone where supposedly it would cause crashes b/c of the small processor but come on!

And yes we have two iphones, a macbook, and ipods. And yes I love apple products.

I am sure there is something between the two extemes that I quoted that makes sense, most people that I know who like Apple products express similar thoughts. I’m the one who does not get it….I just buy a laptop and go on my way…certainly from the ardent support from Apple users, there is something special with what Apples does well.

Well I have a work laptop that is a Thinkpad. My macbook never ever crashes and never has little problems with the internet, etc. It cost more but it was worth it for my personal computer. Plus the touchpad is lightyears better than my IBM’s. That being said, I couldn’t use my Macbook for work b/c most of the programs I use wouldn’t work for Mac (plus my company picks not me). I always had Dells until this Macbook. I would say that for what I do its far superior in reliability and ease of use to my prior Dells. The wife bought a Dell laptop a year after I bought my Macbook and that thing already has problems.

I wouldn’t use Apple for everything, but browsing, music, etc, its perfect. Which is why I don’t get no flash on the iPad. But whatever. I think secretly Jobs knows it would eat into Macbook sales so he doesn’t allow it.

I have a Dell laptop running WindowsXP, it is about 2 years old, I got it just before Windows did the Vista roll out. I remain pretty satisfied with the machine…a few weeks ago it was acting funky…I believe I recieived and update from Windows and all is copacetic. It really is more the software than the machine.

I often wonder, had the tables been reversed, and Apple took off preferentially to Windows, would the rate of software problems also be reversed…it has to be pretty complicated with the ka jillion code writers trying to interface or the hackers trying deface.

Agree totally to your point. However, I think the reason my Mac runs so well is its basically all made by the same Company. Some of the parts are manufactured by others like Intel for the processor, but as Apple says its all made specifically for the one computer. I think when you get too many software companies integrating then that causes problems. Which is why my work laptop always has problems. Way too many programs from different companies.

That being said, I think PC’s are great and have used them my whole life, Starting with an HP desktop we got when i was in 4th grade. I’m just saying for my home laptop I use for music, pictures, and surfing the web I love the stability I get with my Mac.

So Far

I haven’t had any problems surfing the web and/or watching videos. I have read in other reviews where people have had issues but I haven’t. I have the wifi+3G version so there may be a little difference I don’t know. I had the Masters App on my iPhone during the whole tournament and watched live coverage all 4 days. Did you download the app for the Masters? Adobe and Apple are in a pissing match and we all know who will win. Give it 90-120 days and the replacement for Adobe will surface to partner with Apple. Overall I give the iPad a 9.5 out of 10.

90-120 days? you’re kidding. for one, in most senses, the replacement already exists in the open HTML5 format. For another, flash is not just some little thing, its an entire programming library and environment. Additionally, to develop something to replace flash in website design is not a 3-4 month process but would take years and wouldn’t be supported on apple.

about the credibility about the administration, the n/surgeon, and the alumni assn that their talking points generated as much interest as the oversized iphone. If
Tech and Leach can’t settle, then procede tnru the steps and go to court. How it affected other team members? Give me a break…

From the looks of all the comments posted in the e-mail regarding Tech’s motion to dismiss…I think this backfired. Lots of folks still in support of Leach and down with the administration. I for one don’t appreciate the RRC club supporting this but I can see the TTU Alumni Assoc. spewing this garbage.

Love the rivalry comment about Tech and Texas being one of the best games to witness. Also, Hocutt (LB) looks to be very motivated to say the least. We need that kind of enthusiasm.

But he’s waiting for an offer from Texas Tech. That’s the battle we need to keep winning if we are ever going to sniff a championship in the Big 12 South.

Sov immunity

Said it before, from a non-lawyer common sense pov. All coaching contracts aren’t worth the paper they’re written on if State U can assert sov immunity. JMO.
