Not by a long shot. The Texas Supreme Court's decision merely ruled that Mike Leach could not recover monetary damages against Tech. Leach can still maintain his suit against Tech and recover the following:

1. A ruling that Tech breached it's contract with Leach.

2. A ruling that Tech must pay all of his legal fees, court costs, and expenses (which by now are easily seven figures).

3. A ruling that Tech acted with willful malice.

Before any one goes off half-cocked and makes any defamatory statements for which they might be sued, please consult a trial attorney and ask if this is not 100% correct.

Unfortunately, the linchpin of this entire fiasco is the irreversible damage it has done to Tech's image nationally.

By now I'm sure you have heard that the producers of Friday Night Lights are considering making a movie based on the Tech/Leach events.

Also, SI is planning a cover story on this for their April or May 2012 issue (I know this because we have worked together on numerous projects).

And last, but certainly not least, a screenplay is already in the works to turn this into a major motion picture.

I may have been a D student in math at Tech, but even I can tell you that this is gonna cost the Red and Black a heckuva lot more that $800,000.00 and a nondisclosure agreement.

So be a hater if you wish, but sometimes the truth and harsh reality hurts. And nothing at this moment could be more apropos than the age-old question, "Would you rather be right, or would you rather be happy?".

I think Mr. Grigg and cronies hope that Coach Leach does not have the tenacity or wherewithal to pursue this case further, but I like you think that this is not the end by any means, even if the guilty should hope it to be so.

With Regards to Mr. Grigg, WTF?

He must either think Tech fans are stupid, delusional, or both. Even worse, he is a Class of ’70 TTU grad who thinks we are not smart enough to sort through the facts ourselves.

Via ESPN, Grigg said he didn’t know what Leach could gain moving forward. “We’ll just have to wait and see what that is,” he said. “Whatever the claim is, it’s not monetary.”

WTF!

He is pissing on our legs and trying to tell us it’s raining. He is full of shit. He knows exactly what Mike Leach has to gain. Attorneys fees, court costs, and most importantly, his reputation.

If he believed Tech did nothing wrong, then why was sovereign immunity used as an invisible cloak instead of defending their actions? Any answers out there, huh?

Now that this ruling, which was without opinion (which is very important legally), is in the books, Leach can formally proceed with his suit against Tech.

And a storm is coming. Tech is going to pay a heavy price, and I will bet anyone out there Mr. Grigg will be nowhere near the courtroom when Leach calls his first witness.

On a thread over there, the owner said he has been fair in handling both sides in this crapfest but them has to throw in a comment about him working with leach for the 10 years he was here.

So what you didn’t like him but don’t run your board like a North Korean boot camp. He doesn’t realize that the few vocal idiots on that board that trash leach are the exception rather than the norm.

In a case like this, where the court has ruled money isn't in the mix

I’d be more than surprised if the court required Tech to pay Leach’s “reasonable and fair” legal fees. Just because you lose a case doesn’t automatically mean you have to pay the opponents bills. In fact, that can get tangled up for a while, as well. And if you don’t pay, nothing really happens to you. They would have to sue you AGAIN to get the money. Trust me, I’m in the middle of a $1.21 mm suit at work against contractors who built our building. Winning a suit means very little and is often the first battle to get paid.

That said, I’ll be glad when this goes away and the DTN internet indignation dies down. It’s trite, dramatic and overdone at this point. Discuss the case, sure, but quit acting like you were personally wronged. You weren’t,;Leach was. Your college made a bad decision. Now, go live your life. You still have your job – nobody got fired because they went to Tech and their boss canned them because of this mess. Your university, in the eyes of the vast majority not connected to it, looks just fine. It’s our own who insist our university is trashed – not people on the outside. Odd.

A Few Things

1. I am sure I am taking it more personally than most.

2. I am sure there are some people who are taking it more personally than I am.

3. Since I (along with some relatives who are also Tech grads) live in the Northeast, we will have to agree to disagree that this is trite, dramatic, and overdone (I mean, a movie is being made about it!). It’s like a cancer. It keeps growing and growing and none of it is good.

4.. You are patently incorrect regarding the issue of money. Money is still in the mix. Perhaps millions of dollars are still in the mix. The Texas Supreme Court specifically ruled, by way of not issuing a written opinion, that Leach may still maintain his suit against Tech. He is precluded from winning any monetary (money) damages. However, he is still specifically allowed to have a jury trial, have his name cleared of any wrongdoing, and collect any and all reasonable and necessary attorneys fees and expenses. If you wish, I will pull out my O’Connor’s Texas Rules of Civil Procedure book and cite you every relevant section and passage of law pertaining to this matter, verbatim.

5. We will have to agree to disagree that this is trite, dramatic, and overdone. Among other things, a book has been written about it and a movie is being based on it. You call that trite? A human being’s name and reputation is at stake and you call that “trite”? Would you let someone or somebody slander you and your family’s name and dismiss it as being “trite”? It’s like a cancer. It keeps growing and growing and none of it is good.

6. You are correct. Just because you win a lawsuit doesn’t mean the other side is gonna pay your legal bills. Even if the court rules in your favor, there is still a lot of work to be done to collect the money. However, Tech is not “judgment proof” (one thing they taught us in law school was never to sue poor people). Tech has the means to pay any judgment rendered against it.

7. Again, we will have to respectfully agree to disagree. If you are ordered to pay a judgment and refuse a judge can hit you with any number of sanctions if you refuse the court’s order. But I could be wrong. Even though I, for the most part, stopped practicing law many years ago, I am licensed in New York, not Texas. I only received my Masters of Law degree in Texas.

8. As soon as Tech returns the money I have donated to it, takes my family’s name off a building, and quits asking me to donate more, I will stop feeling as if I were personally wronged. Sound fair?

I agree with you 100% that almost every one would like to see this to go away as soon as possible, however, that is wishful thinking.

But if you or your family’s name were unfairly defamed as Leach’s was, would you just give up? If so, then you are a much better man than I.

Our University has been trashed because of Hance, James etc. Leach is doing what any one with a pulse would do. Fight to clear his name of any wrongdoing. How a few morons don’t get that is beyond me.

I don't think that this has hurt tech's reputatiin nationally

What Tech did was a CYA, after a top media personality threatened to sue for his son’s injury. Imagine what would have happened if james’ accusation would be true and we did not fire Leach. Tech acted in its best interest. Remember the initial decision was to ban leach for one game (as missou did with pinkel in 2011) and investigate this internally but lleach threatened to take tech to court and things escalated from there

Tech’s and Leach’s images have both been hurt. But what gets me, by most comments here, is that apparently everything is the Administration’s fault and poor little Mike Leach is without an ounce of responsibility. Mistakes were made by BOTH parties.

Leach put a bullseye on his back the previous year during contract negotiations that were tainted by his continuing efforts to shop his services elsewhere without informing his boss. I have no doubt they were looking for a way to get rid of him or hoped he would go elsewhere but after the best season in Tech history they had to keep him. The James episode was just the match to start the fire. Craig James and his ESPN connections (same type entity that now want to make money on the story or with a movie) would not have let a proper or complete investigation take place before damning Leach AND Tech in the media if Tech did not act quickly. So Tech asked Leach to make an apology and sign a statement he would not abuse players. Instead of making sometype of backhanded apology (I sure Mike could have come up with something.) and agree to not do something he was already not doing, he tells his bosses to f*** themselves and walks out expecting no response on their part. Now more than pissed Tech suspends him for the bowl game and until a complete investigation is made. What does Leach do? Sues his boss to allow him to coach the game. What do you expect to happen? Tech has their ammunition now and Leach has stirred his detractors to a boiling point, they fire him and of course if you are going to fire someone you do it before a $800,000 bonus is due.

Cold and calculated, you bet it is and it happens everyday of the week. I am sure many here would love to get some dirt on Hance such as a financial impropiety or just the scent of one. You would use that to get him to resign his position or the Regents to fire him because of how it reflects on the university even though later, after a full investigation, he was found to be innocent of any wrong doings.

The Spin problem is this: all books written at this time are by Leach or are his view point, any movies or stories will no doubtedly be the same. So Tech gets the blackeye and Leach’s reputation is intact. He has not suffered as much from this incident from the allegations as he has from his reaction to them by suing everyone. He was a hard sell as a coach to many universities prior to being fired. That is why he had not already left Tech on his own. Afterwards, he could have got a job many places but not at school that he wanted not because they were afraid he would abuse players but because of how he fought with administration at Tech and was embroiled in multiple lawsuits. You are hiring a new coach, do you want to bring all that baggage along with him?

Time has lessen the blow and Washington State has come calling. I would have predicted more interest if he still was not in lawsuits. He can pursue this per RdRdr1988 but I hope that he doesn’t because I do not see anyone winning anything. Lawsuits like this will bring out things that neither party really want exposed to the public.

Finally RdRdr1988, unless Seth has banned you from DTN, you can post what you want but don’t threaten Seth or anyone on here with a lawsuit just because they disagree with you or actually use your own words to put a frame of reference around your posts. Otherwise go somewhere else to rant.

Lets talk about how things went bad.

Before the 2008 season Leach was offered a contract, according to Leach a contract that he was wiling to sign. Hance pulled the contract back and decided to wait until after the season to negotiate a new contract. Leach proceeded to screw Hance over by having a really good season. Even after the 2008 season, Hance was out in the media saying that he wasn’t sure that Tech would even offer Leach a new contract. If you want to say Leach is a bad guy for looking around at other jobs fine, but to my way of thinking Hance forced him to consider leaving. If you want to find the bad guy in this situation, you don’t need to look past our chancellor.

I don’t think Tech’s reputation would have been harmed by saying that the matter had been thoroughly investigated and determined the charges to be false. Tech should have gone further and pursued fraud charges against the James.

Can't believe I'm late to this party!

So I read all the links Seth put up and it looks like Kyle Rancourt @ CougCenter also hand-slapped RR8891. Not only was it hilarious, but “doucher” came to mind.
Regardless, whether or not a movie gets made and Tech’s name gets tarnished, in the grand scheme of things, who cares?! I get the anger and sadness over Leach’s firing. It sucks and he’s missed. Especially after the football year we’ve just had to endure. Nevertheless, we all know the people involved did wrong things and it may eventually ALL get exposed, assuming of course no one dies based on the alleged death threats by Pamela Stroud’s post below or TTU04’s belief that his world could be screwed. Just writing that last part made me think how ridiculous this whole thing is, it’s not like we just figured out that Lee Harvey Oswald didn’t act alone.
My whole point in this is that in the grand scheme of things, universities and their athletic programs (mainly football) have scandals, be it illegal recruitment, not paying for tattoos, point shaving, selling drugs, alleged sex and abuse of minors, steroid use, unregistered guns, etc. I look at our issue minor compared to those just mentioned – our coach was fired, our administration didn’t want to pay, and a notable sports figures son was embarrassed. I know I overly simplified the main issue here, but I know some of you will understand where I’m coming from. Time heals all wounds and I can honestly say mine is all gone.

I seldom see any issue totally black or white. But the author of this post just seemed to have so much anger it makes me wonder what the point was to the post. What did he/she want us DTN readers to do? besides agree with his opinion or quit donating money to Tech or both. People can both if they wish.

Thank you for standing up, Seth. I side with you on this one. Facing reality and admitting that mistakes were made is one thing, but these posts are just too negative in tone. I don’t want to read threats. We should all be able to state a reasonable opionion without worrying about being sued.

I wish I could turn the clock back, but cannot. I must live in the present and move into the future. I do think that a TV show, a movie, the book, and these lawsuits are all destructive to Tech’s image, and Austin, I do agree that these have affected the financial support Tech is getting from donors. I wish it were not so, but what can I do except decide for myself. I and my tiny donations will continue to support my alma mater academically and athletically. But I am just a stubborn person who can’t quit hoping for the best for my school. I am not important.

What can I do? I do not agree with all US policy, politicians, health care, budget, laws, etc. But if a president and congressman get elected that I do not like, I do not abandon my citizenship. I speak out and write letters. And vote. I cannot say that I agree with everything the Tech board, president, former AD, and Chan. have done. So if I do not like the administration, I can start writing letters. And keep writing them, and fill them with compelling facts and reasoning. And then write some more and make phone calls. Or I can get angry on a blog site. No point.

Like the Penn State case, it is not over, and the more we find out later, the more bad guys we will find, till we find out that almost everyone involved made mistakes. I hope that all people involved with the late 2009 events will agree to back down, agree to a solution that lessons the losses for all, meet somewhre in the middle, and ends this as soon as they can. That is naive and will not happen, but I am ready for a bright forecast for my school on and off the field. I think it will happen, but it may be years coming.

I wish the parties would agree to a solution but it is not going to happen now. I wonder if any legit offers to settle were made by either party before Leach sent his letter 2-3 weeks ago. Leach can walk away without any harm except monetarily as most think he got screwed by Tech and now by the Texas Courts. Tech now has no reason to settle, they basically have won. Settling now admits to errors and mistakes they have refuted. If Leach continues lawsuit, wins and is awarded his legal fees Tech would pay only because they are forced to and not because they accept the verdict of the lawsuit. They will maintain they were still in the right and the courts screwed them. No winners out of continuing the lawsuit. Tech will character assasinate Leach on every little thing he did for the 10 years he was coach.

Please everyone walk away. Let them write their books, produce their shows, make their movies. An official response refuting the facts and/or how they are presented or portrayed will be made and it will sting everytime we see or hear it until it just does not interest anyone anymore. Aren’t you glad you are not Penn State? Think about how long that is going to linger and the books and the shows and the movies.

I haven’t seen that either. It’s obvious the dude needs to relax a little. How much fun can life be when a reaction is to threaten a lawsuit anonymously on a college athletics blog? If Wikipedia had a picture for the word “Winner of Life” I imagine tough lawsuit guy up above’s pic would win out 100% of the time.

I have a question regarding "Double T Double Cross" that seems to fit here.

It has been a rainy, good book reading day, so I finished the book. My question is regarding contract negotiation rules. If (1) the Southern Association of Colleges and Schools prohibit contract discussion from the Board of Regents and donors and (2) it appears there are emails from Larry Anders, Jerry Turner and Jim Sowell that show violations, then (3) why has there been no repercussions?

I've got an email exchange from between Tech, Tech's SCAC rep, and myself.

I asked that exact question and was given the run around. Tech claimed it had done nothing wrong. The SCAC rep told me if I felt a violation had occurred (which I confirmed) I had to start the complaint process with Tech. I then forwarded her response to the three stooges and their band and quickly received a response with everybody and their dog cc’d by Tech with the employee contact info of the person at Tech that handles the complaints. The email response from Tech also had more prying questions. I then checked the website of where I work and in the analytics I had 29 hits total from Lubbock, TX on that day. 17 clicked on the “Our Administration” tab and the rest were on the “Our Board of Trustees” tab. To say they were very interested in me and who had the power to shut me up is an understatement. I stopped the process at that point. If those in charge right now are crazy enough to pull a stunt like Leach I wouldn’t put it past them to screw my world as well.

Gee, doesn’t sound like they liked the questioning. But your story brings up the question—why didn’t SCAC do something about this like they did with Auburn? SCAC requiring you to jump through all those hoops just makes them look dumb. This case is well documented in the press, and not enforcing the regulation against contract negotiation by BOR and donors —well, why have the regulation in the first place if you don’t enforce it?

Is this factually correct?

I am no lawyer, but my understanding is that the Texas Supreme Court decided that Tech could use sovereign immunity to avoid being forced to live up to the terms of it’s contract.

I am NOT a lawyer

But my understanding is that the Supreme Court ruling does mean Leach cannot get monetary relief. He can, however, still press his case to prove he was unfairly terminated to “clear his name”.

Someone please correct me if I’m wrong because I want to make sure I understand this correctly. Thanks!

I am hoping that one of our lawyer type people could explain this quote. It does seem to me that it is a mis-characterization of the ruling from a person that should know better. If I am correct then it would seem to me that it was given in an attempt to mislead the unwashed masses. Which would be quite offensive to me that Texas Tech would think that I am either incredibly uninformed or too stupid to understand the difference.

I'm no lawyer, but many have emptied my pockets over the years.

I say that “technically” correct.

At this moment, right now, Tech does not owe Mike Leach a penny. And that may stand the test of time. But my interpretation of the situation is that this current fact could be changed by a future ruling in Leach’s favor (in his effort to clear his name) that calls for Tech to pay legal fees. At that point, Tech would owe Leach money. If I am correct here, that would mean the the big Dicky is correct as of the moment.

You are saying that one effect of the ruling is that the contract cannot be enforced, but I do not think the Supreme Court ruled at all as to whether or not Tech owed Mike Leach money. Huge difference in my mind.

Why I'm still confused. But maybe I shouldn't be.

So the post was actually pro-Leach or pro-Tech at first, but then he’s been documented to have posted all the other shit on here and coug center. Factual facts documented by Seth. Which is technically real journalism- reporting actual facts that are really real actual facts in an unbiased factual manner. That is, the posting of the facts that this guy really did post those other things. A truly refreshing turn from the “journalism” that exist today, but that’s a whole nother thing, and that topic certainly doesn’t apply here. Anyway it’s too bad this guy has become a bad lemon in the sphere of Tech alums.

But anyway, he’s all over the place, which is why I guess I’m still confused. As it were, it may be a product of my desire to believe in the goodness of people, particularly other DTN’ers.
